At ClaimCart Inc. (“ClaimCart,” “we,” “our,” or “us”), we value your privacy and are committed to protecting your personal information. This ClaimCart Privacy Policy explains how we collect, use, disclose, store, and protect your information when you visit our website, create an account, use our services, claim an item from a storefront, or otherwise interact with ClaimCart.

ClaimCart Inc. is a Canadian company incorporated in Alberta. While our business is based in Canada, our services are available to customers in both Canada and the United States. We are committed to handling personal information responsibly and in accordance with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”), the Personal Information Protection Act (Alberta) (“PIPA”), and, where they apply, United States state privacy laws.

We collect, use, and disclose personal information only with your consent or as otherwise permitted or required by law. By creating an account, subscribing, claiming an item, or otherwise providing personal information to us, you consent to the practices described in this Privacy Policy for the purposes identified here. You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us as described below, although this may affect our ability to provide the Services to you.

Who This Policy Covers

This Privacy Policy applies to two groups of people:

  • Sellers: people who create a ClaimCart account and subscribe to operate a storefront. ClaimCart collects and controls Sellers’ personal information for its own purposes, as described in this Policy.

  • Visitors: people who open a storefront link shared by a Seller and claim items. When you claim an item, the information you enter (your name, email address, and phone number when you create a Visitor account, and your shipping address when you finalize a claim) is collected on behalf of the Seller so that the Seller can contact you to complete the transaction. ClaimCart hosts that information for the Seller and uses it only to provide the Services, to keep the Services secure, and as otherwise described in this Policy. The Seller is responsible for how they use your information after they receive it, and you should contact the Seller with questions about their practices. ClaimCart does not send marketing messages to Visitors and does not itself contact Visitors about their claims; claim status updates are shown in your Visitor account.

Sellers agree to collect, use, and disclose Visitor information only for the purpose of completing the transaction requested by the Visitor and in compliance with applicable privacy and anti-spam laws, and to honour any request a Visitor makes to access, correct, or delete their information.

1. Information We Collect

We may collect information that you provide directly to us, information collected automatically when you use ClaimCart, and information received through trusted third-party service providers.

Information You Provide

Depending on how you use ClaimCart, we may collect:

  • Name

  • Email address

  • Phone number, and shipping or mailing address (Visitors provide a shipping address when finalizing a claim)

  • Account login credentials

  • Business or storefront information

  • Profile photo or logo

  • Product information, descriptions, pricing, and images

  • Billing information (processed securely by our third-party payment processor)

  • Information you enter when claiming an item from a storefront (Visitors)

  • Records of items listed, claimed, and marked as sold through your storefront

  • Communications you send to our support team

You are responsible for ensuring that you have the necessary rights or permission to upload any content, including images, logos, product descriptions, and other materials, to ClaimCart.

We do not store your full payment card information. All payment processing is handled securely by our third-party payment processor in accordance with its own privacy and security practices. Our payment processor may be located in, and may process your billing information in, the United States.

2. Information We Collect Automatically

When you visit our website or use ClaimCart, certain information may be collected automatically to help us operate, improve, and secure our services.

This information may include:

  • IP address

  • Browser type and version

  • Device type and operating system

  • Pages visited and time spent on our website

  • Date and time of your visit

  • Referring website or link

  • General location information based on your IP address (such as country or region)

  • Actions taken within the Services, such as logging in, creating listings, and sharing storefront links

We may also use cookies and similar technologies to remember your preferences, keep you signed in to your account, analyze website traffic, and improve your experience while using ClaimCart. See Section 5 for details.

The information collected automatically is generally used for analytics, security, troubleshooting, and improving the performance of our website and services. We do not use this information to personally identify you unless necessary for security, fraud prevention, to enforce our Terms of Service, to respond to support requests, or to comply with legal obligations.

3. How We Use Your Information

We use the information we collect to provide and improve ClaimCart, operate our services, and deliver a secure and reliable experience for our users.

Your information may be used to:

  • Create and manage your ClaimCart account.

  • Set up and maintain your storefront.

  • Deliver claim requests from Visitors to the relevant Seller.

  • Process subscription payments securely through our third-party payment processor.

  • Send important account-related communications, including account verification, password resets, billing notifications, and service updates.

  • Send you product updates, training resources, feedback requests, and other marketing communications about ClaimCart features and offers, where you have consented to receive them or where otherwise permitted by law. You can unsubscribe at any time.

  • Respond to customer support requests and inquiries.

  • Improve the functionality, performance, and user experience of ClaimCart.

  • Monitor and protect the security of our website, services, and user accounts.

  • Detect, investigate, and prevent fraud, unauthorized access, or other activities that may violate our Terms of Service.

  • Respond to intellectual property complaints and enforce our Intellectual Property Policy, including forwarding notices to Sellers as required by the Copyright Act (Canada).

  • Comply with applicable laws, regulations, and legal obligations.

We may also use aggregated or anonymized information to better understand how ClaimCart is used, identify trends, improve our platform, and develop new features. Once information has been aggregated or anonymized so that it no longer identifies or could reasonably be used to identify an individual, it is no longer personal information and may be used and retained by ClaimCart without restriction.

ClaimCart does not sell, rent, or trade your personal information to third parties for their own marketing purposes. We do not use your personal information for automated decision-making that produces legal or similarly significant effects about you, and we do not use your content to train artificial intelligence models.

4. When We Share Your Information

We only share your personal information when necessary to operate ClaimCart and provide our services, or as otherwise described in this Policy.

We may share your information with:

  • Our third-party payment processor, to securely process subscription payments.

  • Trusted service providers who help us operate, maintain, and improve ClaimCart, such as cloud hosting, email delivery, customer support, and analytics providers. These providers may only use your information to provide services to us and are required to protect it.

  • The Seller whose storefront you used, if you are a Visitor, so that the Seller can complete your claim.

  • Law enforcement or government authorities when required by law or to protect our legal rights, including in response to a subpoena, court order, or other lawful request.

  • Rights holders and complainants, limited to forwarding notices as required by law. We do not disclose a Seller’s identity to a complainant without the Seller’s consent or a court order.

  • A buyer or successor in connection with a merger, acquisition, financing, or sale of all or part of our business, provided the recipient agrees to protect your information in a manner consistent with this Policy.

  • Our professional advisors, such as lawyers, accountants, and insurers, where necessary.

  • Others with your consent or at your direction.

We do not sell, rent, or share your personal information with third parties for their own marketing purposes, as described in Section 3.

Cross-Border Transfers

ClaimCart is based in Alberta, Canada. Some of our service providers, including our payment processor (Stripe), our hosting and content delivery providers (Cloudways and Cloudflare), our email delivery provider (Brevo), and our analytics provider (Google Analytics), are located in or store information in the United States, the European Union, or other countries outside Canada. As a result, your personal information may be transferred to, stored, and processed outside Canada, and outside your province or country of residence.

While your information is outside Canada, it is subject to the laws of that jurisdiction, and may be accessible to courts, law enforcement, and national security authorities there under those laws. We use contractual and other measures to require our service providers to protect your information to a standard comparable to that required in Canada.

If you have questions about our use of service providers outside Canada, or about the collection, use, disclosure, or storage of your personal information by those providers, please contact our Privacy Officer using the details in Section 12.

If you are located in the United States, you acknowledge that your personal information will be transferred to and processed in Canada, where privacy laws may differ from those in your state.

5. Cookies and Tracking Technologies

ClaimCart uses cookies and similar technologies to help our website function properly, remember your preferences, improve your experience, and better understand how our website is used.

We use the following types of cookies:

  • Strictly necessary cookies, which keep you signed in, secure your session, and make the Services work. These cannot be switched off.

  • Preference cookies, which remember your settings.

  • Analytics cookies, which help us understand how visitors use the website so we can improve it. We may use Google Analytics for this purpose. You can learn how Google uses data at policies.google.com/technologies/partner-sites and can opt out using the Google Analytics opt-out browser add-on at tools.google.com/dlpage/gaoptout.

We do not currently use advertising or cross-site tracking cookies. If that changes, we will update this Policy and, where required, ask for your consent first.

You can control or disable cookies through your browser settings. Please note that disabling certain cookies may affect the functionality of ClaimCart. Our website does not currently respond to browser “Do Not Track” signals, but we do not engage in the cross-site tracking those signals are designed to address.

6. Data Security

We take reasonable measures to protect your personal information from unauthorized access, loss, misuse, or disclosure. These measures include encryption of data in transit, password hashing, access controls that limit who within ClaimCart can view personal information, and the use of reputable hosting and payment providers that maintain their own security programs.

While no method of transmitting or storing information over the internet can be guaranteed to be completely secure, we work to maintain appropriate security practices to help safeguard the information you provide. ClaimCart cannot guarantee the absolute security of your information and is not responsible for unauthorized access, use, or disclosure resulting from factors beyond our reasonable control.

If we become aware of a security incident that affects your personal information, we will take appropriate steps in accordance with applicable laws, including notifying affected individuals and the Office of the Privacy Commissioner of Canada and the Office of the Information and Privacy Commissioner of Alberta where the incident creates a real risk of significant harm, and keeping records of the incident as required by law.

7. Data Retention

We retain your personal information only for as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements.

If you close your ClaimCart account, we will securely delete or anonymize your personal information within 30 days, unless we are required by law to retain certain information (for example, billing and tax records, which we keep for seven years, and records relating to intellectual property notices, which we keep for the period required by the Copyright Act). Information in routine backups is deleted on our normal backup rotation cycle.

If your subscription ends but you do not close your account, we may keep your account and storefront data for up to 90 days so that you can reactivate your subscription, after which it is deleted or anonymized on the same basis.

Visitor information collected through a storefront is retained while the Seller’s account is active and is deleted on the same schedule when the Seller closes their account or deletes the listing, unless the Visitor or the Seller asks us to delete it sooner.

Sellers can export their product listings from their account at any time, and can download or print receipts for individual claims, before closing their account.

If you would like us to delete your ClaimCart account, you may contact us using the information provided at the end of this Privacy Policy. We will process your request in accordance with Section 8.

8. Your Privacy Rights

You have rights regarding your personal information under applicable privacy laws.

You may request to:

  • Access the personal information we hold about you, and learn how it has been used and to whom it has been disclosed.

  • Correct or update your personal information.

  • Delete your account and personal information, where permitted by law.

  • Withdraw your consent where applicable.

  • Opt out of marketing communications at any time.

To make a privacy-related request, please contact us using the information provided at the end of this Privacy Policy. We will respond within 30 days, or within any shorter period required by law, and may ask you to verify your identity before acting on your request. We may charge a reasonable fee for access requests where the law allows, and will tell you in advance if so. If we refuse a request, we will tell you why and how you can challenge our decision.

If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada (priv.gc.ca) or the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca).

Additional rights for United States residents

If you live in a US state with a comprehensive privacy law, you may also have the right to confirm whether we process your personal information, to obtain a portable copy, to opt out of the sale of personal information, targeted advertising, and certain profiling (we do not engage in any of these), and to appeal a decision on your request by contacting our Privacy Officer. We will not discriminate against you for exercising your rights. Authorized agents may submit requests on your behalf with proof of authority.

9. Children’s Privacy

ClaimCart is intended for individuals who are at least 18 years of age or the age of majority in their jurisdiction. We do not knowingly collect personal information from children under 18.

If we become aware that personal information has been collected from a child under 18, we will promptly delete that information.

10. Third-Party Services

ClaimCart works with third-party service providers to help operate our website and deliver our services.

These providers currently include services for:

  • Secure payment processing (Stripe).

  • Website hosting and infrastructure (Cloudways and Cloudflare).

  • Email communications (Brevo).

  • Website analytics (Google Analytics).

These third-party providers have their own privacy policies and are responsible for how they collect, use, and protect information provided through their services. Our website and storefronts may also contain links to third-party websites that we do not control. This Policy does not apply to those websites.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our services, legal requirements, or business practices. Your continued use of ClaimCart after the updated Effective Date constitutes your acceptance of the revised Privacy Policy.

When we make changes, we will update the Effective Date at the top of this page. If the changes are material, we will also notify Sellers by email or through the Services before they take effect and, where required by law, seek your consent. We encourage you to review this Privacy Policy periodically to stay informed about how we protect your information.

If you have any questions about this Privacy Policy or how we handle your personal information, please contact us. We have designated a Privacy Officer who is accountable for our compliance with this Policy and applicable privacy laws. The name of our Privacy Officer is available on request.

13. Governing Law

This Privacy Policy is governed by the laws of the Province of Alberta and the applicable laws of Canada. Any dispute arising under or in connection with this Privacy Policy will be subject to the exclusive jurisdiction of the courts of the Province of Alberta.
